ORDERING
 

All orders are processed as soon as possible after receipt; once an order for a custom product has been placed and printed it is not possible to cancel it. We will email an estimated dispatch time.
Production times for each product vary, estimated times are given by email depending on the product ordered. Items which are printed by a supplier acting on our behalf may take longer, and is not under our control. If you need your order urgently, or by a certain deadline, please email or phone first. We will do our very best to help you.
If for any reason a product cannot be supplied, or is not available, we will inform you as soon as possible and issue a full refund.

Custom made products, including all photographic images such as prints, canvas prints and greetings cards, are made to order and are not eligible for return under the distance selling regulations unless damaged or defective so please choose carefully. Full product descriptions, including whether it is a custom-made item, are on the website under the menu heading 'Buy – Product descriptions'.
We reserve the right to cancel an order should it be of questionable origin and issue a refund.
UK orders are accepted on receipt of online payment.
All prices include UK VAT where applicable.
For non-UK destinations please email or phone so we can find the most cost-effective method of shipping for your products. If you order products from our website for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

 


COLOUR MATCHING AND PRODUCT QUALITY


Devices such as computer monitors, tablets and phones all produce slightly different colours. Therefore, the printed colour may not look exactly the same as you see on your monitor screen, especially if your screen is not colour calibrated. Colours also vary slightly between products depending upon which inks and media are used. We aim to produce a pleasing, colour balanced product which is as close to the original as possible but we cannot guarantee an exact colour match with your screen or between different product types.
We make every effort to ensure you receive a high-quality product but in the unlikely event of the product being unsatisfactory, please phone or email us within 48 hours and we will do everything possible to resolve the issue.

DELIVERY


UK delivery charges (where applicable) are stated at the checkout before payment is taken.
Non-UK delivery charges will be advised on request before accepting your order.
A notification of dispatch will be sent by email, with a tracking number where available. Small items are normally sent by Royal Mail First Class, larger items may be sent by courier.

RETURNS AND REFUNDS


• Digital content
Digital content is not eligible for return.

• Custom products
Most items for sale on this site are custom made products. These include all photographic images such as prints, canvas prints, framed prints and photographic albums, they are made to order and are not eligible for return under the Consumer Protection (Distance Selling) Regulations 2000. They may only be returned if damaged in transit or there is a manufacturing defect.
• Other products
Where sales are covered by the distance selling regulations and are cancelled, such as books, the buyer is responsible for returning the goods to us at their own expense. We recommend you insure the goods while in transit as goods not received or received damaged will not be refunded.

• Damages, returns and refunds
Please notify us of any damages or defects within 24 hours of receipt (so we can inform the carrier) by phone or email, see Contact page of our website. If the package requires a signature and is damaged please note that with the carrier at the time of delivery. We will contact you with a returns number and instructions on how to return. Returns will not be accepted without prior notification and a returns number.
Products for return must be sent within 7 days of receipt including the original packaging. It is your responsibility to wrap products adequately to prevent damage. We recommend that you obtain proof of posting and insurance as goods not received, or received damaged, will not be refunded. Your name, address, order number and returns number must be included in the package together with a description of the damage or defect. We will supply you with the return address.
A full refund, including original and reasonable return postage costs, will be issued on receipt of the products, subject to inspection and the goods being found damaged or defective. Damage suspected as malicious and deliberate will void our returns agreement and sales contract.
All sales are final, but in the unlikely event that we, or a supplier acting on our behalf, are unable to complete an order you will receive a full refund.
• Incorrect fulfilment.

If we send you the wrong photo or product we will refund or replace it free of charge.

LIABILITY


We shall not be liable for direct loss, incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims. We do our best to get all orders despatched as quickly as possible. We have no liability to you for any delay in the delivery of products ordered. We will keep you informed as to the progress of your order. This warranty does not affect your statutory rights.

TERMS OF THE SERVICES

In the following “the photographer” and “Mickaël” refers to Mickaël Malaper founder of Malaper Photography. By booking a photo session with Malaper Photography you agree with the following terms and conditions.

1. Commercial

1.1. Estimate

 

An estimate will be sent to the client based on the initial assessment of the photographic work to be carried out. This will include but not limit costs for time, expenses, production, image and retouching fee. All retouching is to be carried out in house by Malaper Photography and not by the client or any third party unless otherwise agreed in writing.

1.2. Addtional fee

If the photographic job is outside of Bristol area (more than 15 miles away from BS8) or in a foreign country, additional fees will be added, including but not limited to travel expenses, accommodation, food, etc. These fees have to be agreed between Malaper Photography and the client before the photographic work taking place. In the event of a cancellation of services all expenses already paid will be non-refundable.

1.3. Payment

 

50% of estimate price, all agreed expenses and production costs must be paid in advance of the photo shoot. All other fees must be paid within 14 days of the invoice date. Where extra expenses or time are incurred by the photographer as a result of alterations to the original brief, the client shall be liable to pay such extra costs.

1.4 Fast track Services

Malaper Photography reserves the right to make an additional charge should the Client request a fast track service. This service is subject to availability and cannot be guaranteed.

1.5. Right to a credit

The photographer must be credited on all editorial uses, publications and in other cases if stated on the estimate.

 

1.6. Copyright

The entire copyright in the photographs (including ownership of all materials) is retained by Malaper Photography and Mickaël Malaper at all times, throughout the world, unless otherwise agreed in writing.

 

1.7. Digital files

Once digital files from your photoshoot are handed over it’s your responsibility to take measures to ensure they’re securely backed up in several places. Malaper Photography recommends portable hard drives and online cloud storage facilities. Malaper Photography cannot guarantee files will be kept more than 20 days after the initial files delivery.

1.8. Rejection

 

There is no right to reject photographs on the basis of style or composition as it is the client’s responsibility to view the photographer’s portfolio and assess if it fits to his expectations. In the event of technical problem with delivery of the photographs Malaper Photography will either send the files by other means or repeat the photo shoot.

 

1.9. Force Majeure

 

Performance of contracts is subject to alteration or cancellation by Malaper Photography owing to a cause beyond its control. In the unlikely event of any technical failure for whatever reason, liability shall be limited to a refund of monies paid, excluding any booking fee and expenses incurred, including but not limited to travel expenses and production costs, etc. Malaper Photography is insured for public liability. Your statutory rights are not affected.

2. Sports Photography

2.1. Estimate

An estimate will be sent to the client based on the initial assessment of the photographic work to be carried out. 4. Family Photoshoot

4.1. Booking

You’ll be required to pay a £40 non-refundable booking deposit when arranging your photo session. That deposit will then be redeemable against the payment for the photo session pack you choose with Malaper Photography.

When booking a session, you acknowledge that deposits are never refundable. Please be aware that by booking any session with Malaper Photography you are holding a session spot and that the photographer is relying on your session for income. Please be considerate if you should need to reschedule an appointment and provide at least a 72 hours notice. Deposits are transferable to only one new date and always subject to the photographer's availability.

4.2. Cancellation/Rescheduling

The initial booking deposit is non-refundable, except for extreme circumstances which will be at the discretion of the photographer (illness, injury etc). Outdoors sessions can be rescheduled by the photographer due to weather if necessary up to three times.

 

4.3. Expenses & Payment

If an extensive journey is needed for the photo session, agreed expenses must be paid by the client in advance of the photo shoot (travel, parking, accommodation, food, etc.). Full payment for the photo session is due 14 days prior to the session date agreed. In the event that payment is not made in full by this deadline, the Photographer reserves the right to terminate the booking, retain the initial deposit, and no longer be held liable for providing further services to the Client. Where extra expenses or time are incurred by the photographer as a result of alterations to the original brief, the client shall be liable to pay such extra costs.

4.4. Refunds

Unless agreed in writing for specific circumstances at photographer’s discretion, the booking deposit will not be refunded if the client would decide to cancel a photo session and chose not to reschedule it. No refund will be issued after the photo shoot took place.

4.5. Copyright

The entire copyright in the photographs (including ownership of all materials) is retained by Malaper Photography and Mickaël Malaper at all times, throughout the world, unless otherwise agreed in writing.

4.6. Location and weather

Photo shoot will be held at a location of your choice within Bristol and the surrounding areas provided that it is not restricted area for photography purposes. If you prefer Mickaël to choose he can suggest different locations to suit your individual tastes. Locations that are more than 15 miles outside of Bristol area (BS8) will incur a travel cost of 45p per mile. If weather conditions are poor, photo shoot will be cancelled the day before or in the morning on the day of your appointment.

4.7. Viewing your pictures and file storage

Your images will be uploaded to an online gallery within 10 days of your photo shoot. Once they’re online they’ll remain visible for 14 days for client to view or purchase the pictures files. 20 days after delivery of the files Malaper Photography will remove all the pictures files from their hard drive apart from the ones that the client agreed for Malaper Photography to use for promotional purposes.

4.8. Digital Files

Once digital files from your photoshoot are handed over it’s your responsibility to take measures to ensure they’re securely backed up in several places. Malaper Photography recommends portable hard drives and online cloud storage facilities. Malaper Photography cannot guarantee files will be kept more than 20 days after the initial files delivery.

4.9. Rejection

There is no right to reject photographs on the basis of style or composition as it is the client’s responsibility to view the photographer’s portfolio and assess if it fits to his expectations. In the event of technical problem with photographs Malaper Photography will either send the files by other means or repeat the photo shoot.

4.10. Other

Photo sessions may involve physical activity. This is undertaken at your own risk. All children under the age of 18 must be accompanied by a parent or parental guardian.

5. Portrait

5.1. Booking

You’ll be required to pay a £40 non-refundable booking deposit when arranging your photo session. That deposit will then be redeemable against the payment for the photo session pack you choose with Malaper Photography.

5.3. Expenses & Payment

If an extensive journey is needed for the photo session, agreed expenses must be paid by the client in advance of the photo shoot (travel, parking, accommodation, food, etc.). Full payment for the photo session is due 14 days prior to the session date agreed. 7. "Pay what you want" photo session

7.1. Definition of "Pay what you want" photo session

"Pay what you want" photo session is a promotional offer by Malaper Photography running on a monthly basis. Every month Malaper Photography will advertise this offer on social media. This will be offered on a first comes first served basis for the first person to comment, like the post, and subscribe to Malaper Photography on Facebook page or Instagram. This offer is redeemable only once per customer/household/business.

This session includes 1 hour photo session at customer's choice location, an online gallery of 60 pictures, 4 high resolution images download, any additional pictures will need to be purchased separately (Prices can be found here).

7.2. Booking

You’ll be required to pay a £20 refundable booking deposit when arranging your photo session. That deposit will then be redeemable against the payment for the photo session price chosen by the Client.

Please be aware that by booking any session with Malaper Photography you are holding a session spot and that the photographer is relying on your session for income. Please be considerate if you should need to reschedule an appointment and provide at least a 72 hours notice. Deposits are transferable to only one new date and always subject to the photographer's availability.

7.3. Cancellation/Rescheduling

The initial booking deposit or any money paid will be fully refundable in case of cancellation up to 72 hours (for individuals / 1 week for businesses) prior to the session. If client cancels less than 72 hours (1 week for businesses) before the session any payment made will become non-refundable except for extreme circumstances which will be at the discretion of the photographer (illness, injury etc). Outdoors sessions can be rescheduled by the photographer due to weather if necessary up to three times.

 

7.4. Expenses & Payment

If an extensive journey is needed for the photo session, agreed expenses must be paid by the client in advance of the photo shoot (travel, parking, accommodation, food, etc.).  Payment for the "Pay what you want" photo session is due no later than the day of the photo shoot. Failure to do so will result in the photo session being cancelled by the Photographer and the initial booking deposit of £20 being retained to offset its loss of business, in case the photo shoot will have already happened the Client will have no entitlement to any of the benefits included in the package unless payment is made.

Where extra expenses or time are incurred by the photographer as a result of alterations to the original brief, the client shall be liable to pay such extra costs.

7.5. Refunds

 

Should the client decide to cancel the "Pay what you want" photo session with Malaper Photography more than 72 hours (1 week for businesses) before the session the booking deposit of £20 will be refunded in full if he chooses not to reschedule the session.

Unless agreed in writing for specific circumstances at photographer’s discretion, the booking deposit will not be refunded if the client would decide to cancel a photo session less than 72 hours (1 week for businesses) of the session and choose not to reschedule it. No refund will be issued after the photo shoot took place.

7.6. Copyright

The entire copyright in the photographs (including ownership of all materials) is retained by Malaper Photography and Mickaël Malaper at all times, throughout the world, unless otherwise agreed in writing.

7.7. Location and weather

Photo shoot will be held at a location of your choice within Bristol and the surrounding areas provided that it is not restricted area for photography purposes. If you prefer Mickaël to choose he can suggest different locations to suit your individual tastes. Locations that are more than 15 miles outside of Bristol area (BS8) will incur a travel cost of 45p per mile. If weather conditions are poor, photo shoot will be cancelled the day before or in the morning on the day of your appointment.

7.8. Viewing your pictures and file storage

Your images will be uploaded to an online gallery within 10 days of your photo shoot. Once they’re online they’ll remain visible for 14 days for client to view or purchase the pictures files. 20 days after delivery of the files Malaper Photography will remove all the pictures files from their hard drive apart from the ones that the client agreed for Malaper Photography to use for promotional purposes.

7.9. Digital Files

Once digital files from your photoshoot are handed over it’s your responsibility to take measures to ensure they’re securely backed up in several places. Malaper Photography recommends portable hard drives and online cloud storage facilities. Malaper Photography cannot guarantee files will be kept more than 20 days after the initial files delivery.

7.10. Rejection

There is no right to reject photographs on the basis of style or composition as it is the client’s responsibility to view the photographer’s portfolio and assess if it fits to his expectations. In the event of technical problem with photographs Malaper Photography will either send the files by other means or repeat the photo shoot.

7.11. Other

Photo sessions may involve physical activity. This is undertaken at your own risk. All children under the age of 18 must be accompanied by a parent or parental guardian.

8. Mini photo session

8.1. Definition of Mini photo session

Mini photo session is a 20 to 30 minutes photo session and can be used for headshots or portraits, couples, family or maternity (Prices can be found here).

8.2. Booking

You’ll be required to pay a £20 non-refundable booking deposit when arranging your photo session. That deposit will then be redeemable against the payment for the photo session pack you choose with Malaper Photography.

When booking a session, you acknowledge that deposits are never refundable. Please be aware that by booking any session with Malaper Photography you are holding a session spot and that the photographer is relying on your session for income. Please be considerate if you should need to reschedule an appointment and provide at least a 72 hours notice. Deposits are transferable to only one new date and always subject to the photographer's availability.

8.3. Cancellation/Rescheduling

The initial booking deposit is non-refundable, except for extreme circumstances which will be at the discretion of the photographer (illness, injury etc). Outdoors sessions can be rescheduled by the photographer due to weather if necessary up to three times.

The Client may reschedule the date of the photo session ONCE to another date, by giving notice to the Photographer no later than 72 hours prior to the session, this should be agreed with a written confirmation of the Photographer.

Shall the Client cancel within less than 72 hours before the session he will not be entitled to a refund of the monies paid to date.

 

8.4. Expenses & Payment

Full payment for the photo session is due 14 days prior to the session date agreed. In the event that payment is not made in full by this deadline, the Photographer reserves the right to terminate the booking, retain the initial deposit, and no longer be held liable for providing further services to the Client.

Where extra expenses or time are incurred by the photographer as a result of alterations to the original brief, the client shall be liable to pay such extra costs.

8.5. Refunds

 

Should the client decide to cancel the "Pay what you want" photo session with Malaper Photography more than 72 hours before the session the booking deposit of £20 will be refunded in full.

Unless agreed in writing for specific circumstances at photographer’s discretion, the booking deposit will not be refunded if the client would decide to cancel a photo session less than 72 hours of the session and choose not to reschedule it. No refund will be issued after the photo shoot took place.

9. Gift vouchers

9.1. Definition of gift vouchers

A gift voucher can be purchased to offer for family, portrait, maternity, or mini session, for the value corresponding to the pack desired. This gift voucher will be delivered by email under the form of a voucher code after reception of the corresponding payment.

9.2. Payment/Refund

Once the session pack to be purchased as gift is chosen the full payment corresponding to the pricing of the pack (Sunrise, Highlight, Golden hour or mini session) is to be made to Malaper Photography prior to the vouchers being sent.

Gift vouchers will not be refundable after 7 days from the date of purchase. Once the photo session has taken place no refund will be issued. Any changes to an order placed is to be made within 24 hours of the purchase date.

9.3. Voucher value & upgrade

 

Should the pricing of the session pack chosen at the purchase of the gift voucher increase by the date of the session taking place, no extra payment will be required from the recipient of the voucher and similar service will be offered.

Should the client decide to upgrade his session pack to a higher end pack, only the difference between the current price of the package and the upgraded pack will be payable.

9.4. Validity

Upon the date of purchase of the gift voucher and reception of the email with the voucher, it is valid for use for a year or 12 months and can be redeemed agains corresponding photo session. Malaper Photography won't be liable to deliver any photography services should the gift voucher not be used during its validity period.

10. Price & Terms

All prices shown within Malaper Photography’s price list are subject to change without prior notice. Malaper Photography reserves the right to amend these Terms and Conditions without prior notice.
